Use of the site
Eligibility
By accessing or using damanclubplay.in.net (the "Site"), you confirm that you are at least 18 years of age and legally competent to enter into binding agreements under the laws of India. Access to certain features may require identity verification in accordance with applicable Know Your Customer (KYC) guidelines issued by Indian regulatory authorities. If you do not meet these requirements, you must discontinue use of the Site immediately.
Permitted use
You may access and use the Site solely for lawful purposes and in accordance with these Terms of Service. You agree not to transmit unsolicited advertising, introduce malicious software, attempt unauthorised access to any server or database connected to the Site, or engage in conduct that restricts another person's use or enjoyment of the Site. Any attempt to manipulate outcomes, exploit technical vulnerabilities, or use automated scripts to interact with the Site is strictly prohibited and may result in immediate account suspension.
Account responsibilities
If you register an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Daman Club recommends enabling two-factor authentication where available. You agree to notify us immediately of any unauthorised access. Daman Club shall not be liable for any loss or damage arising from your failure to safeguard your account credentials.
Intellectual property
Ownership
All content published and made available on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, is the property of Daman Club or its content suppliers and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian intellectual property legislation, as well as relevant international conventions to which India is a signatory.
Trademarks and branding
The name "Daman Club", its logo, and all related product and service names, designs, and slogans are trademarks of Daman Club. You must not use such marks without prior written permission. Unauthorised use of Daman Club's trademarks in connection with any product or service is likely to cause confusion and constitutes infringement actionable under Indian law.
Limited licence to users
Daman Club grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only. This licence does not include the right to reproduce, resell, or exploit any portion of the Site; create derivative works; or use data mining, scraping, or similar data extraction methods. Any licence granted hereunder terminates automatically if you breach any provision of these Terms.
Limitation of liability
Disclaimer of warranties
The Site and all content, services, and features provided through it are offered on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Daman Club does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted under applicable Indian law, Daman Club disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Cap on liability
To the maximum extent permitted by law, Daman Club, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your access to, or inability to access, the Site. Where liability cannot be wholly excluded, Daman Club's total aggregate liability shall not exceed the amount paid by you to Daman Club in the thirty (30) days immediately preceding the event giving rise to the claim.
Third-party services
The Site may integrate with third-party payment processors, including PhonePe, Google Pay, and BHIM UPI, for transaction purposes. Daman Club does not control and is not responsible for the content, security practices, or availability of any third-party services. Any dispute arising from a payment processed through a third-party gateway must be resolved directly with the relevant service provider in accordance with their terms and conditions.
